Although Responsible Conduct of Research training is common in the sciences, the effectiveness of RCR training is open to question. Three key factors appear to be particularly important in ensuring the effectiveness of ethics education programs: educational efforts should be tied to day-to-day practices in the field, educational efforts should provide strategies for working through the ethical problems people are likely to encounter in day-to-day practice, and educational efforts should be embedded in a broader program of on-going career development efforts. The extensive qualitative analyses resulted in the identification of nine metacognitive reasoning strategies on which future RCR training will be developed. Integrity is a critical determinant of the effectiveness of research organizations in terms of producing high quality research and educating the new generation of scientists. A number of responsible conduct of research (RCR) training programs have been developed to address this growing organizational concern. However, in spite of a significant body of research in ethics training, it is still unknown which approach has the highest potential to enhance researchers’ integrity. One of the approaches showing some promise in improving researchers’ integrity (...) has focused on the development of ethical decision-making skills. The current effort proposes a novel curriculum that focuses on broad metacognitive reasoning strategies researchers use when making sense of day-to-day social and professional practices that have ethical implications for the physical sciences and engineering. This sensemaking training has been implemented in a professional sample of scientists conducting research in electrical engineering, atmospheric and computer sciences at a large multi-cultural, multi-disciplinary, and multi-university research center. A pre-post design was used to assess training effectiveness using scenario-based ethical decision-making measures. The training resulted in enhanced ethical decision-making of researchers in relation to four ethical conduct areas, namely data management, study conduct, professional practices, and business practices. In addition, sensemaking training led to researchers’ preference for decisions involving the application of the broad metacognitive reasoning strategies. Individual trainee and training characteristics were used to explain the study findings. Broad implications of the findings for ethics training development, implementation, and evaluation in the sciences are discussed. (shrink)

ABSTRACT BACKGROUND: The objective of this study was to identify factors motivating women to take part in endometriosis research and to determine if these factors differ for women participating in clinical versus basic science studies. METHODS: A consecutive series of 24 women volunteering for participation in endometriosis‐related research were asked to indicate, in their own words, why they chose to volunteer. In addition, the women were asked to rate, on a scale of 0 to 10, sixteen potentially motivating factors. The (...) information was gathered in the form of an anonymous self‐administered questionnaire. RESULTS: Strong motivating factors (mean score >8) included potential benefit to other women's health, improvement to one's own condition, and participation in scientific advancement. Weak motivating factors (mean score <3) included financial compensation, making one's doctor happy, and use of ‘natural’ products. No difference was detected between clinical and basic science study participants. CONCLUSION: This study is the first study to specifically investigate the factors that motivate women to take part in endometriosis research. Understanding why women choose to take part in such research is important to the integrity of the informed consent process. The factors most strongly motivating women to participate in endometriosis research related to improving personal or public health; the weakest, to financial compensation and pleasing the doctor. Late in 1990, the Center for the Study of Ethics in the Professions at Illinois Institute of Technology (lIT) received a grant of more than $200,000 from the National Science Foundation to try a campus-wide approach to integrating professional ethics into its technical curriculum.! Until very recently, feminist criticism has not had a theoretical basis; it has been an empirical orphan in the theoretical storm. In 1975, I was persuaded that no theoretical manifesto could adequately account for the varied methodologies and ideologies which called themselves feminist reading or writing.1 By the next year, Annette Kolodny had added her observation that feminist literary criticism appeared "more like a set of interchangeable strategies than any coherent school or shared goal orientation."2 Since then, the expressed goals (...) have not been notably unified. Black critics protest the "massive silence" of feminist criticism about black and Third-World women writers and call for a black feminist aesthetic that would deal with both racial and sexual politics. Marxist feminists wish to focus on class along with gender as a crucial determinant of literary production. Literary historians want to uncover a lost tradition. Critics trained in deconstructionist methodologies with to "synthesize a literary criticism that is both textual and feminist." Recent semantic approaches to scientific structuralism, aiming to make precise the concept of shared structure between models, formally frame a model as a type of set-structure. This framework is then used to provide a semantic account of (a) the structure of a scientific theory, (b) the applicability of a mathematical theory to a physical theory, and (c) the structural realist’s appeal to the structural continuity between successive physical theories. In this paper, I challenge the idea that, to be so used, (...) the concept of a model and so the concept of shared structure between models must be formally framed within a single unified framework, set-theoretic or other. I first investigate the Bourbaki-inspired assumption that structures are types of set-structured systems and next consider the extent to which this problematic assumption underpins both Suppes’ and recent semantic views of the structure of a scientific theory. I then use this investigation to show that, when it comes to using the concept of shared structure, there is no need to agree with French that “without a formal framework for explicating this concept of ‘structure-similarity’ it remains vague, just as Giere’s concept of similarity between models does ...” (French, 2000, Synthese, 125, pp. 103–120, p. 114). Neither concept is vague; either can be made precise by appealing to the concept of a morphism, but it is the context (and not any set-theoretic type) that determines the appropriate kind of morphism. I make use of French’s (1999, From physics to philosophy (pp. 187–207). Cambridge: Cambridge University Press) own example from the development of quantum theory to show that, for both Weyl and Wigner’s programmes, it was the context of considering the ‘relevant symmetries’ that determined that the appropriate kind of morphism was the one that preserved the shared Lie-group structure of both the theoretical and phenomenological models. A common view is that, whether taught in philosophy departments or elsewhere, practical ethics should include some introduction to philosophical ethics. But even an entire course cannot afford much time for this and expect to do justice to ethical concerns in the practical area . The concern is that ethical theories would need to be “watered down,” or over-simplified. So, we should not expect that this will be in good keeping with either the theories or the practical concerns.In addressing this (...) problem, we turn to philosopher Thomas Reid . He insisted that, because morality is for everyone, one needn’t be a philosopher to understand its requirements. Although it can be useful to organize our moral thinking around a few basic principles, a system of morality is more like a system of botany or mineralogy than geometry. Most scholars have focused on The Second Sex and Simone de Beauvoir’s fiction, concentrating on gender issues but ignoring her broader emancipatory vision. Though Beauvoir’s political thinking is not as closely studied as her feminist works, it underpinned her activism and helped her navigate the dilemmas raised by revolutionary thought in the postwar period. In Emancipatory Thinking Elaine Stavro brings together Beauvoir’s philosophy and her political interventions to produce complex ideas on emancipation. Drawing from a range of work, including (...) novels, essays, autobiographical writings, and philosophic texts, Stavro explains that for Beauvoir freedom is a movement that requires both personal and collective transformation. Freedom is not guaranteed by world historical systems, material structures, wilful action, or discursive practices, but requires engaged subjects who are able to take creative risks as well as synchronize with existing forces to work towards collective change. Beauvoir, Stavro asserts, resisted the trend of anti-humanism that has dominated French thinking since the 1960s and also managed to avoid the pitfalls of voluntarism and individualism. In fact, Stavro argues, Beauvoir appreciated the impact of material, socio-economic, institutional forces, without forgoing the capacity to initiate. Applying Beauvoir’s existential insights and understanding of embodied and situated subjectivity to recent debates within gender, literary, sociological, cultural, and political studies, Emancipatory Thinking provides a lens to explore the current political and theoretical landscape. Much has been said about intuitionistic and classical logical systems since Gentzen’s seminal work. Recently, Prawitz and others have been discussing how to put together Gentzen’s systems for classical and intuitionistic logic in a single unified system. We call Prawitz’ proposal the Ecumenical System, following the terminology introduced by Pereira and Rodriguez. In this work we present an Ecumenical sequent calculus, as opposed to the original natural deduction version, and state some proof theoretical properties of the system. We reason that (...) sequent calculi are more amenable to extensive investigation using the tools of proof theory, such as cut-elimination and rule invertibility, hence allowing a full analysis of the notion of Ecumenical entailment. We then present some extensions of the Ecumenical sequent system and show that interesting systems arise when restricting such calculi to specific fragments. This approach of a unified system enabling both classical and intuitionistic features sheds some light not only on the logics themselves, but also on their semantical interpretations as well as on the proof theoretical properties that can arise from combining logical systems. BackgroundReflexive pitch perturbation experiments are commonly used to investigate the neural mechanisms underlying vocal motor control. In these experiments, the fundamental frequency–the acoustic correlate of pitch–of a speech signal is shifted unexpectedly and played back to the speaker via headphones in near real-time. In response to the shift, speakers increase or decrease their fundamental frequency in the direction opposing the shift so that their perceived pitch is closer to what they intended. The goal of the current work is to develop (...) a quantitative model of responses to reflexive perturbations that can be interpreted in terms of the physiological mechanisms underlying the response and that captures both group-mean data and individual subject responses.MethodsA model framework was established that allowed the specification of several models based on Proportional-Integral-Derivative and State-Space/Directions Into Velocities of Articulators (DIVA) model classes. The performance of 19 models was compared in fitting experimental data from two published studies. The models were evaluated in terms of their ability to capture both population-level responses and individual differences in sensorimotor control processes.ResultsA three-parameter DIVA model performed best when fitting group-mean data from both studies; this model is equivalent to a single-rate state-space model and a first-order low pass filter model. The same model also provided stable estimates of parameters across samples from individual subject data and performed among the best models to differentiate between subjects. The three parameters correspond to gains in the auditory feedback controller’s response to a perceived error, the delay of this response, and the gain of the somatosensory feedback controller’s “resistance” to this correction. Excellent fits were also obtained from a four-parameter model with an additional auditory velocity error term; this model was better able to capture multi-component reflexive responses seen in some individual subjects.ConclusionOur results demonstrate the stereotyped nature of an individual’s responses to pitch perturbations. Further, we identified a model that captures population responses to pitch perturbations and characterizes individual differences in a stable manner with parameters that relate to underlying motor control capabilities. Future work will evaluate the model in characterizing responses from individuals with communication disorders. (shrink)

Subprime mortgages instruments, complex derivatives and overleveraging in investment banks were major provocateurs in bringing down the economy. Volkswagen’s deceptive practices in measuring diesel fuel efficiency follows. The final example of greed is Boeing and the shoddy decision-making processes on the Boeing 737 MAX that led to the catastrophic crashes resulting in 346 deaths. In Gradient Acceptability and Linguistic Theory, Elaine J. Francis examines a challenging problem at the intersection of theoretical linguistics and the psychology of language: the problem of interpreting gradient judgments of sentence acceptability in relation to theories of grammatical knowledge. This problem is important because acceptability judgments constitute the primary source of data on which such theories have been built, despite being susceptible to various extra-grammatical factors. Through a review of experimental and corpus-based research on a variety of syntactic (...) phenomena and an in-depth examination of two case studies, Francis argues for two main positions. The first is that converging evidence from online comprehension tasks, elicited production tasks, and corpora of naturally-occurring discourse can help determine the sources of variation in acceptability judgments and narrow down the range of plausible theoretical interpretations. The second is that the interpretation of judgment data depends crucially on one's theoretical commitments and assumptions, especially with respect to the nature of the syntax-semantics interface and the choice of either a categorical or a gradient notion of grammaticality. The theoretical frameworks considered in this book include derivational theories (e.g. Minimalism, Principles and Parameters), constraint-based theories (e.g. Sign-based Construction Grammar, Simpler Syntax), competition-based theories (e.g. Stochastic Optimality Theory, Decathlon Model), and usage-based approaches. While showing that acceptability judgment data are typically compatible with the assumptions of various theoretical frameworks, Francis argues that some gradient phenomena are best captured within frameworks that permit soft constraints-non-categorical grammatical constraints that encode the conventional preferences of language users. This paper addresses the problems that must be considered if computers are going to treat their users as individuals with distinct personalities, goals, and so forth. It first outlines the issues, and then proposes stereotypes as a useful mechanism for building models of individual users on the basis of a small amount of information about them. In order to build user models quickly, a large amount of uncertain knowledge must be incorporated into the models. The issue of how to resolve (...) the conflicts; hot will arise along such inferences is discussed. A system, Grundy, is described that builds models of its users, with the aid of stereotypes, and then exploits those models to guide it in its task, suggesting novels that people may find interesting. If stereotypes are to be useful to Grundy, they must accurately characterize the users of the system. Some techniques to modify stereotypes on the basis of experience are discussed. An analysis of Grundy's performance shows that its user models are effective in guiding its performance. (shrink)

What is the role of gesture in classroom science talk? This study first approaches the question generally, by asking how children communicate their knowledge of the seasons. We then ask how gestures function as they interplay with language in students' science talk. A typology, coded for High or Low lexical and gestural specification, summarized how thirteen sixth graders externalized their knowledge of seasonal change. Applying it to sixteen student discourse excerpts, we tested its usefulness as an analytical tool. Representational gestures (...) functioned as redundant to, or enhancing of ideas expressed through speech, or alternatively as carriers of scientific meaning. Findings show that gestures are an expected mode of communication in the science classroom. They can reveal student knowledge that is missing from verbal communication. Additionally, gestures may figure crucially in the construction as well as the communication of scientific insights. (shrink)

How tax practitioners approach ethical dilemmas remains generally unexplored in academic literature. We use here Rest’s original Defining Issues Test (Development in judging moral issues. Minneapolis: University of Minnesota Press, 1979; Moral development. Advances in research and theory. New York: Praeger Publishers, 1986), combined with a tax context-specific test and in conjunction with a control group of non-tax specialists, to examine tax practitioners’ moral reasoning in a social and tax context. We investigate: (i) the effect of a tax context on (...) issues raised (finding that practitioners generally reason at lower levels than in social scenarios); (ii) whether the profession attracts people who reason at certain levels (finding that it does not); and (iii) whether practitioners are affected by training/socialization in their professional context (finding that that they are). I just completed the first year of a two-year graduate program in one of the top MA programs for conference interpreters—many of the graduates ended up working at the United Nations and international agencies. Many of my classmates chose to work in top business or government agencies for (...) their summer internships. I wanted to do something different. Something that I may never cross paths with again if I miss the opportunity. So, I chose to work as a healthcare interpreter intern at a large healthcare system. The summer internship was supposed to be a refreshing break from the drudgery of rigorous training to be a conference interpreter at an international level.As a graduate student who has received one year of intensive practicum training, I was proud of my "overqualification." At that time and to this day, the norm for most training programs for professional healthcare interpreters is a 40-hour short course (e.g., Bridging the Gap). With my advanced training and language proficiency, I thought this would be a fun, easy detour in my career development. I was excited to work with real people, no longer trapped in the isolating interpreting booths with headphones in conference rooms.Little did I know that the summer internship would change my life and career trajectory. The first big jolt that challenged my confidence as an interpreter was also one of the first assignments I received. I was taking an elderly man to his first physical therapy session. The man had such severe scoliosis that he was essentially looking backward as he walked forward. As we walked into the clinic, a medical resident saw my patient and jumped up in excitement. With a great smile on his face, he exclaimed, "Wow! This is the worst case I have ever seen." I felt startled. I could see that the patient was unsure about the resident's excitement. Normally, I would just go ahead and interpret what the physician said. I would then introduce the patient to the physician, explain my role as an interpreter (e.g., "I will interpret everything you and the patient say so you understand each other"), and proceed to interpret what other speakers said.However, all my training as an interpreter failed me at that moment. It's not because I was unsure about the linguistic equivalences of the resident's comment in Chinese. Rather, I was unsure how to best convey the information in a faithful, neutral, and accurate way without risking the provider-patient relationship and the quality of care. I explained to the physician, "Hi, my name is Elaine, and I am the healthcare interpreter. I am responsible for helping the patient understand what others are saying." Then, I asked, "How would you like me to interpret what you just said? You appeared very excited." The resident was taken aback, paused for a moment, and said, "Please tell him that I'm very happy to meet him." I interpreted that and proceeded to my regular routines.Another memorable moment took place at the end of a long shift near the end of my summer internship. I was already packing up to head home when I received a call to assist a 90-year-old patient who had just been admitted to a mental health ward after a failed suicide attempt a few hours ago. As an interpreter, I was required to interpret everything in the first-person style. For example, instead of saying, "The patient is sad," I say, "I am sad." This essay addresses the implications of German Idealism and Romanticism, and in particular the philosophy of Schelling as it is informed by Kant and Goethe, for contemporary environmental philosophy. Schelling's philosophy posits a nature imbued with freedom which gives rise to human beings, which means that any ethics, insofar as ethics is predicated upon freedom, will be an ‘environmental ethic’. At the same time, Schelling's organismic view of nature is distinctive in positing a fundamental gap between nature and human beings. (...) Without this absolute alterity, there could be no real ethical relationship between human beings and nature. I conclude by briefly gesturing toward Schelling's role in the development of an ethics of alterity (which I apply to environmental ethics) in continental philosophy through Heidegger, Derrida, and Levinas. Feferman argues that category theory cannot stand on its own as a structuralist foundation for mathematics: he claims that, because the notions of operation and collection are both epistemically and logically prior, we require a background theory of operations and collections. Recently [2011], I have argued that in rationally reconstructing Hilbert’s organizational use of the axiomatic method, we can construct an algebraic version of category-theoretic structuralism. That is, in reply to Shapiro, we can be structuralists all the way down ; (...) we do not have to appeal to some background theory to guarantee the truth of our axioms. In this paper, I again turn to Hilbert; I borrow his distinction between the genetic method and the axiomatic method to argue that even if the genetic method requires the notions of operation and collection, the axiomatic method does not. Even if the genetic method is in some sense epistemically or logically prior, the axiomatic method stands alone. Thus, if the claim that category theory can act as a structuralist foundation for mathematics arises from the organizational use of the axiomatic method, then it does not depend on the prior notions of operation or collection, and so we can be structuralists all the way up. I examine the relation between logic and nature in terms of ‘reflection’, the word that Hegel uses at the end of theEncyclopaedia Logicto describe the self-sundering or externalization of the idea into nature. Although nominally the term ‘reflection’ seems to denote a uniquely mental process and is often used so by Hegel in his early critique ofReflexionsphilosophie, in his later writings it also has an irreducibly ontological significance. Hegel describes logic's opening-out to nature as a movement of ‘reflection’ [Widerschein] and (...) he follows Kant in describing the shift from the finite to the infinite in the relation between nature and thought as one of reflective judgement. Although Hegel generally considers reflection to be uniquely concerned with finite cognition and the constitution of finite things, I argue that in his embrace of reflective judgement he sees a key role for reflection in the relation of logic, nature and spirit. In this paper I argue that the fragmented plant references in Theodor Adorno’s Minima Moralia form a constellation figuring experience (understood in a very specific sense) decimated through instrumental reason. Plants appear in Adorno’s text as symptoms, shock fragments of unprocessed experiences that cannot be taken up retrospectively in memory. The injured alliance between experience and memory necessitates a new relation between nature and art, as nature, falsely accessible in its immediacy, can only be reached, in memory, through the mediation (...) of art. From 1850 to 1930, important Egyptologists and archaeologists energetically excavated and uncovered temples, tombs, and works of art. Which for millennia had been hidden under desert sands. At the same time, photographers struggled under relentless Egyptian sun to overcome technological and physical difficulties to record the new finds, as well as the already-known monuments in the Nile Valley. Both disciplines promote new knowledge and interest in ancient Egypt. This book brings that period to life with a wealth of images of sites along the Nile, all selected from the collection of early prints, stereoviews, and postcards housed at the Frank H. McClung Museum at the University of Tennessee, Knoxville. The prints by pioneer photographers illustrate why people came to Egypt and what it was that seized their imaginations. The book also describes more than fifty ancient objects loaned to the museum to complement its exhibition of the photographs. These objects were excavated and documented in or near many of the photographed sites at which the earnest Egyptologists and image-makers worked. Elaine A. In lieu of an abstract, here is a brief excerpt of the content:Fighting Words:Turnus at Bay in the Latin Council (Aeneid 11.234–446)Elaine FanthamUntil the publication of Philip Hardie's important new discussion "Fame and Defamation in the Aeneid: The Council of Latins" (1998), Virgil's extended treatment of the Latin council had passed a generation of relative neglect—neglect all the more surprising because the debate occupies a quarter of the eleventh book.1 But then the book itself is generally treated as a (...) lowering of tension, a diversion of focus from the heroic business of male combat to an exchange of rhetoric and the ancillary exploits of the woman warrior Camilla. And despite his long– standing interest in Virgil's Iliad (e.g., 1984), K. W. Gransden's recent commentary on book 11 (1991) shows little interest in Virgil's sophisticated narrative technique.Virgil's writing in this book is no less serious than in its neighbors, and deserves further scrutiny. The Camilla narrative has begun to receive its due, but the rhetoric of the extended council, which includes Turnus' longest speech and the second longest formal speech in the Aeneid, has usually been passed over as alien to the concerns of epic.2This is certainly not Hardie's approach, though it is motivated in part by the same negative attitude toward rhetoric. For him the debate is primarily a starting point for a more far–reaching inquiry into the [End Page 259] ways in which Virgil uses the secondary narrative of speakers to project dissonant versions of events the audience has already experienced, and, by thus casting doubt on their credibility, extends a further shadow of doubt over the narrative enterprise. He states his aim as "to resituate the place of rhetoric within the Aeneid, with especial reference to the most elaborate and most formal exchanges between human actors in the poem. The focus of... discussion is not so much on the formal markers of a rhetorical manner, as on the relationship between the truth–functions of rhetoric and of a supposedly authoritative epic voice" (1998, 243).Now Hardie would probably accept a definition of rhetoric fairly close to "speech designed to persuade." But his reading of the episode shows a mistrust not simply of its most clearly dishonest speaker, but of the entire debate. He opens with Virgil's summary, Illi haec inter se dubiis de rebus agebant / certantes (445–46). Yet insofar as the sphere of rhetoric (as opposed to logic) is, as Aristotle declares, what is debatable, the uncertainty or insecurity of the Latins' circumstances hardly entitles Hardie to damn the entire council as "hot air... just so much rhetoric" (244). It seems that despite his magnificent understanding of epic, Hardie has no sympathy for rhetoric.3 For him "rhetoric" is only the abuse of eloquence. He equates it with public speeches invalidated by the speaker's misreading of circumstances, by distortion of the speaker's own experience,4 by misjudgment swayed by emotion,5 or by misrepresentation to deceive the audience—whereas the only error of several of these speakers is human ignorance of the divinely ordained consequences. Not only Latinus, "careful to provide the optimal conditions for a faithful account by the envoys," but the honest Venulus and right–minded Diomedes are discredited along with Drances, as if no valid speech were possible in a political context. [End Page 260]Hardie has many acute and rewarding comments on the debate, but his major critical contribution lies outside it, reaching even beyond the framework of the Aeneid. The more restricted approach I originally adopted toward the Latin debate, while composing earlier drafts of this essay, does not seem to have lost its usefulness: it is even possible that Hardie's long–sighted vision has produced a distortion that needs to be corrected by a study with a shorter focus. As in the subtle intertextual study by Burke (1978), my point of departure here is the effect of Drances' speech not only on the behavior of Turnus, but on the audience's or reader's reception of Turnus' reply and assessment of his character.6To start, then, let us briefly review the form and content of the council, paying special... This paper analyses the role of a code of ethics for judges in connection to a contemporary definition of responsive ‘T-shaped’ judicial professionalism and the professional-ethical questions which can arise in judicial decision-making regarding politically and societally controversial issues. The paper’s case study focuses on climate-change related litigation in Dutch courts. First, a theoretical framework which conceptualises practical and ethical elements of T-shaped judicial professionalism as ‘virtuous judgecraft’, building on the work of Kritzer and Van Domselaar, addresses the knowledge, skills, (...) and ethical mindset that judges need for fulfilling their roles in relation to this notion of professionalism. Next, the paper analyses to what extent connections with guidelines of the Dutch Guide to Judicial Conduct (GJC), considered in light of the developed framework of virtuous judgecraft, can be recognised in the approaches of judges in the landmark Urgenda judgments. Based on this analysis, the paper presents conclusions regarding the value of the GJC for enhancing judicial performance and for explaining judgments, in particular those which involve complex societal issues, to parties and the general public. Retail banking is facing many challenges, not least the loss of its customers’ trust and loyalty. The economic crisis is forcing banks to examine their relationships with stakeholders and to offer greater reassurance that their brand promises will be delivered. More than ever, banks need to stand for something positive and valued by stakeholders. One way to achieve this is through paying more attention to brand values. Our article explores how values are adopted by employees within a bank. When employees (...) ‘live’ their brand’s values, their behaviour during customer interactions reflects this, encouraging the strengthening of customer relationships. Specifically, we test the relationship between leadership style, employee commitment, and the adoption of values. Data was collected from a survey of 438 branch employees in a leading Irish retail bank. The study found that a structured and directive leadership style was effective at encouraging the adoption of the bank’s values. Moreover, when employees are committed to the organisation, this has a significant impact on their adoption of values. Thus, this study supports the literature which suggests that leadership and commitment are prerequisites for values adoption. (shrink)

ABSTRACT The aim of this project is to account for why we often denigrate intersex and trans bodies as disruptive and threatening. Within a binary understanding of sex and gender, we might call these bodies unruly. They deviate from what is normal but also challenge the very conceptions of normality. Appropriating Simone de Beauvoir's concept of ambiguity as the “paradox of man,” I argue that intersex and trans bodies unsettle us because they reflect the freedom of the body and our (...) associated responsibility in choosing how we live the body. We denigrate these individuals from within a spirit of seriousness, claiming that sex and gender are absolute to abdicate any responsibility for them. That is, we denounce unruly bodies in an attempt to flee from the freedom and responsibility of our own bodies. (shrink)

BackgroundThe amount of research utilizing health information has increased dramatically over the last ten years. Many institutions have extensive biobank holdings collected over a number of years for clinical and teaching purposes, but are uncertain as to the proper circumstances in which to permit research uses of these samples. Research Ethics Boards (REBs) in Canada and elsewhere in the world are grappling with these issues, but lack clear guidance regarding their role in the creation of and access to registries and (...) biobanks.MethodsChairs of 34 REBS and/or REB Administrators affiliated with Faculties of Medicine in Canadian universities were interviewed. Interviews consisted of structured questions dealing with diabetes-related scenarios, with open-ended responses and probing for rationales. The two scenarios involved the development of a diabetes registry using clinical encounter data across several physicians' practices, and the addition of biological samples to the registry to create a biobank.ResultsThere was a wide range of responses given for the questions raised in the scenarios, indicating a lack of clarity about the role of REBs in registries and biobanks. With respect to the creation of a registry, a minority of sites felt that consent was not required for the information to be entered into the registry. Whether patient consent was required for information to be entered into the registry and the duration for which the consent would be operative differed across sites. With respect to the creation of a biobank linked to the registry, a majority of sites viewed biobank information as qualitatively different from other types of personal health information. All respondents agreed that patient consent was needed for blood samples to be placed in the biobank but the duration of consent again varied.ConclusionParticipants were more attuned to issues surrounding biobanks as compared to registries and demonstrated a higher level of concern regarding biobanks. As registries and biobanks expand, there is a need for critical analysis of suitable roles for REBs and subsequent guidance on these topics. The authors conclude by recommending REB participation in the creation of registries and biobanks and the eventual drafting of comprehensive legislation. (shrink)
